नेपाल इन्भेष्टमेण्ट बैंक लि.ले इटालीमा बैंक ग्यारेन्टी सम्बन्धी मुद्दा जित्यो
‘क’श्रेणीको नेपाल इन्भेष्टमेण्ट बैंक लिमिटेडले इटालीमा बैंक ग्यारेन्टी सम्बन्धी मुद्दा जितेको छ । २७ जेठ २०७७ मा सो बैंकबाट जारी गरिएको प्रेस विज्ञप्तिमा उल्लेखित विषय यस प्रकार छ ।
गत सेप्टेम्बर २०१८मा तनहुँ जलविद्युत् लिमिटेडका पक्षमा इटालीको इन्टेन्सा सन्पाओला एसपीएले आफ्नो ग्राहक ओअपरेटिभा मुराटोरी एन्ड सिमेन्टिस्टी (सीएमसी)– सी.एम.सी. दे रेभेना सोसाइटाका लागि नेपाल इन्भेष्टमेण्ट बैंक लिमिटेड (एनआईबीएल)लाई ८५ करोड १४ लाख १६ हजार १ सय २७ रुपैयाँ
र युरो ८७ लाख ४९ हजार २३९ युरो (कुल रकम २ अर्ब १० करोड रुपैयाँ) को काउन्टर ग्यारेन्टी जारी गरेको थियो । यसैबीच एनआईबीएलले सन् २०१९
फेब्रुअरीमा तनहुँ जलविद्युत् लिमिटेडका तर्फबाट ठेकेदार कम्पनी सीमएसीले आफ्नो करार अन्तर्गतको दायित्व उल्लंघन गरेको दाबी प्राप्त ग-यो । इन्टेन्सा सन्पाओला एसपीए माथि बैंक ग्यारेन्टी राशीका लागि एनआईबीएलले माग दाबी गरेपछि उसले इटालीको ट्रिबुनल डे बोलोनाको आदेश भन्दैै रकम भुक्तानीका लागि अस्वीकार ग-यो । एनआईबीएलले तनहुँ जलविद्युत् लिमिटेडको मागलाई बैंक ग्यारेन्टीको
सर्त मुताबिक तत्कालै भुक्तानी गर्न बाध्य थियो ।
यद्यपि, लामो अदालती मुद्दापछि ट्रिबुनाले बोलांगाको पूर्ण इजालसले ९ जुन २०२० (२७ जेठ २०७७)मा यस अघिको इन्टेन्सा सन्पाओला एसपीएले
एनआईबीएललाई बैंक ग्यारेन्टी रकम तिर्नबाट रोक्ने आदेशलाई खारेज गरेको छ । यसरी यो आदेशले अघिल्लो अदालतको आदेशलाई अमान्य घोषित
गरेसँगै एनआईबीएलाई इटालियन बैंकबाट प्रभावकारी रूपमा बैंक ग्यारेन्टीको रकम प्राप्त गर्न निश्चित आधार प्राप्त भएको छ ।

Nepal Investment Bank Ltd. wins Bank Guarantee case in Italy
9 June, 2020:
On September 2018 Intesa Sanpaolo SPA, Bologna, Italy had issued counter guarantees to
NIBL for the amount of NPR 851,416,127 and Euro 8,749,239 ( Total amount NPR. 2.10
billion) in favour of Tanahu Hydropower Limited on account of their client Cooperativa
Muratori and Cementisti (CMC) – C.M.C. di Ravenna Societa. However, on February, 2019
NIBL received claim from Tanahu Hydropower Ltd. stating that their contractor, CMC had
breached its obligations under the contract. As NIBL lodged the claim to Intesa Sanpaolo
SPA for the Bank guarantee amount, Istesa Sanpaolo declined to pay the amount citing the
court order from Tribunale Di Bologna, Italy. NIBL, however, settled the claim immediately
of Tanahu Hydro Power Ltd. as it was bound to pay as per the conditions of guarantee. In the
subsequent hearings, the court had refused revoke the order that prevented Intesa Sanpaolo
SPA to pay the counter guarantees to NIBL.
However, it has been learnt that after a lengthy court case, on 9 June, 2020, a full-bench of
Tribunale Di Bologna has revoked it’s previous decree that had prevented Intesa, San Paolo to
pay the bank guarantee amount to NIBL. Thus, the quashing of previous court order, enables
NIBL to effectively receive the bank guarantee amount from the Italian bank.
